Welcome to Sperkygem. These Terms of Service govern your access to and use of our website, products and services.

Throughout these Terms, “Sperkygem,” “we,” “us” and “our” refer to SG Enterprises, a sole proprietorship operating the Sperkygem brand. “You” and “your” refer to any visitor, customer or person accessing or using our website.

By visiting our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service, along with our Privacy Policy, Refund Policy and Shipping Policy.

Please read these Terms carefully before using our website.

1. Online store terms

By using this website, you confirm that:

You are using the website under the supervision and with the permission of a parent or legal guardian.

Sperkygem offers fashion jewellery, accessories and other products displayed on our website.

Certain products may have slight differences in finish, placement, texture or appearance.

We reserve the right to correct errors or update information at any time, including after an order has been submitted. We will not knowingly substitute an ordered product with a materially different product without your consent.

4. Prices and taxes

All prices are displayed in Indian Rupees unless otherwise stated.

Prices may include or exclude applicable taxes depending on the information shown during checkout. Any applicable product charges, taxes, shipping fees, Cash on Delivery fees or other charges will be shown before you confirm your order.

We may change product prices, discounts and promotions at any time. A price change will not ordinarily affect an order that has already been accepted by us, except where there is an obvious pricing error.

5. Orders and order acceptance

Placing an order does not automatically mean that we have accepted it.

After receiving your order, we may send an order confirmation or acknowledgement. An order is accepted when we confirm that it has been processed or dispatched, subject to product availability, payment verification and other applicable checks.

We may refuse or cancel an order where:

The product is unavailable.
The payment could not be authorised or verified.
The shipping address is incomplete or unsupported.
The order appears fraudulent, suspicious or unauthorised.
An obvious pricing or product-information error occurred.
The quantity appears intended for unauthorised resale.
We are unable to fulfil the order for operational or legal reasons.

Where an online payment has already been collected for a cancelled order, the eligible amount will be refunded to the original payment method in accordance with our Refund Policy.

For Cash on Delivery orders where no payment has been collected, no refund will be applicable.

6. Accuracy of customer information

You agree to provide complete, current and accurate information when placing an order or creating an account, including your:

Email address
Mobile number
Billing address
Delivery address
Payment information, where applicable

You are responsible for reviewing these details before completing your order.

We will not be responsible for delivery failures or delays caused by incorrect, incomplete or outdated information provided by you. Additional shipping charges may apply if an order needs to be reshipped because incorrect information was supplied.

7. Customer accounts and sign-in services

You may be able to access your customer account using an email verification code, Google sign-in or another available authentication service.

You are responsible for maintaining the security of your email account, Google account and any device used to access your Sperkygem account.

Third-party sign-in services are operated by their respective providers and may be governed by their own terms and privacy policies. We are not responsible for interruptions or technical problems caused solely by those third-party authentication services.

Notify us promptly if you believe your account has been accessed without authorisation.

8. Payments

Available payment methods will be displayed during checkout and may include online payments, UPI, cards, wallets or Cash on Delivery.

Online payments may be processed by third-party payment service providers. We do not directly store complete card or banking credentials where they are handled securely by the payment provider.

We may carry out verification checks before accepting or dispatching an order.

You agree not to use payment information that you are not legally authorised to use.

9. Cash on Delivery

Cash on Delivery may be available only for selected orders, products, PIN codes or order values.

We may contact you by phone, WhatsApp, email or SMS to verify a Cash on Delivery order before dispatch.

We reserve the right to:

Refuse Cash on Delivery for certain orders.
Request partial or full prepaid payment where necessary.
Cancel unverified or suspicious orders.
Restrict Cash on Delivery access where a customer repeatedly refuses delivery or places fraudulent orders.

Any Cash on Delivery charges will be displayed during checkout, where applicable.

10. Shipping and delivery

Shipping estimates are provided for guidance and are not guaranteed delivery dates unless expressly stated otherwise.

Delivery may be affected by courier delays, weather, public holidays, operational disruptions, address issues, government restrictions or circumstances outside our reasonable control.

Risk of loss or damage remains subject to applicable law and our responsibilities as the seller. Customers should inspect the parcel upon delivery and contact us promptly if it is damaged, incorrect, incomplete or appears to have been tampered with.

11. Returns, exchanges, cancellations and refunds

Returns, exchanges, order cancellations and refunds are governed by our Refund Policy.

Eligibility may depend on factors such as:

The date on which the request is submitted

Evidence of damage, defect or incorrect delivery

We will not knowingly alter a genuine review in a way that changes its meaning.

14. Intellectual property

The Sperkygem name, logo, website design, product photography, graphics, videos, written content, packaging artwork and other brand material are owned by or licensed to SG Enterprises unless otherwise stated.

You may use our website only for personal, non-commercial shopping purposes.

You must not, without our prior written permission:
